These are the terms governing your usage of the digital webshop platform Phistock.
By entering the website www.phistock.com and by signing these Terms and Conditions (hereinafter: the T&C), you agree to the terms stipulated herein, which form a binding legal contract between Red Moon Marketing FZCO (hereinafter: PhiStock) and the registered user (You).
1 Product Information
1.1 All material available at the www.phistock.com for purchase (hereinafter: Product(s)) are considered digital unless specified otherwise. The Product(s) are made following the data and files the user provides during the ordering process.
2. Prohibited Conduct
2.1. Limitations on Use – you agree that you will not edit, change or in any other way manipulate the purchased products from the PhiStock online store. You accept and acknowledge that you may use said products for your personal use only, without altering or removing any trademark, copyright or other notice from the products delivered. By registering on the website, you agree not to sell, trade, or manipulate any product you receive from the website.
2.2. Disruptive Conduct – you acknowledge and agree that the PhiStock reserves the right to remove you from the PhiStock website if the PhiStock, in its sole discretion, determines that your usage of the platform has created a disruption or hindered the functioning and integrity of the website.
3. Fees
3.1. Payment – the payment of the applicable fees for the Product (s) is due prior to completing the Product (s). If such payment is insufficient or declined for any reason, PhiStock may refuse to complete your order and shall have no liability in this regard.
Please note that all payments will be effected in EURO currency. If the payment is done using foreign issuers payment cards, the total amount of transaction will be converted into bank settlement currency, according to the current exchange rate of The European Central Bank (ECB). Once when the transaction is settled, the already converted amount will be converted into your local currency according to the exchange rate of credit card associations. As a result of this conversion, there is a possibility of a slight difference from the original price stated on our website. In this case, PhiStock shall not be held responsible, nor shall it be obliged to refund the difference in an amount up to the price of the Product(s) in the Euro.
3.2. Payment Methods
Payment of products (tickets) on our webshop can be made by one of the following methods:
1: Payments through accounts and payment cards – VISA, Maestro or MasterCard that support payments via the Internet. Card payment is realized in cooperation with Stripe.

After the card information is entered and the payment is confirmed, the bank authorizes the transaction and the order of the PhiStock Product(s) is approved and ready for the delivery process. The amount in EURO will be reserved on your payment card and will not be available to you for any other purpose.
The transaction will be completed immediately, and the indicated amount in EURO will be charged to your account. In the event that the payment is not completed, the Product (s) will not be delivered to you.
Please contact the bank that issued the card to see if your card supports payments via Internet.
2. PayPal

For the avoidance of doubt, nothing in the T&C herein shall be deemed to vest in you any legal or beneficial right in or to any trademarks or other intellectual property rights owned or used under license by the PhiStock or any of its affiliates; nor does the T&C herein grant you any right or license to any other intellectual property rights of the PhiStock or its affiliates, all of which shall at all times remain the exclusive property of the PhiStock and its affiliates.
5. Guarantees and Limitation of Liability Disclaimer
5.1 The PhiStock gives no guarantees in respect of any aspect of the website www.Phistock.com or any materials related thereto or offered at the website online store and, to the fullest extent legally possible disclaims all implied guarantees, including but not limited to guarantees of fitness for a particular purpose, accuracy, timeliness, and merchantability. The PhiStock website online store is provided on an ‘as-is’ basis. Neither PhiStock nor its affiliates accept any responsibility or liability for reliance by you or any person in any aspect of the usage of the website or any information provided from the website.
5.2 Except as required by law, neither the PhiStock nor its affiliates shall be liable for any direct, indirect, special, incidental, or consequential costs, damages or losses arising directly or indirectly from the PhiStock website or other aspects related thereto or in connection with the T&C herein.
5.3 The maximum aggregate liability of the PhiStock for any claim in any way connected to, or arising from, the Phistock website or these T&C, whether in contract, tort, or otherwise (including any negligent act or omission), shall be limited to the amount paid by you to the PhiStock under these T&C herein.
6. Refund Policy
6.1 – The Product(s) delivered are refundable when both sides (PhiStock and User) are in agreement that the delivered Product(s) is not in accordance with the specifications of the ordered Product(s). The refund is requested via email support@phistock.com.
6.2 If you previously paid by some of the payment cards, in whole or partially, in the event of a refund and regardless of the reason for the refund, the refund will be made only through the same VISA, Maestro or MasterCard card which you used for the payment. This means that our bank will make a refund to the account of the card user at our request. This is in accordance with paragraph 6.1 of this T&C, so If you cancel a Product and ask for a refund after 7 days of purchase, you will not be eligible for a refund.

8.1 If you notice any irregularities in the purchase of the products on our Web site or you have not received the purchased products, please contact our support service via the following email address: support@phistock.com and we will endeavour to correct the irregularities in order for you to get the purchased products.
8.2 If you are unsatisfied with our services or have issues in terms of your payment, please forward your complaint with complete information directly to our support service via the following email address: Support@phistock.com within 2 days following the date when the payment took place.
8.3 Our support services are available to handle all payment support and complaints on business days from Monday to Friday from 9 a.m. to 4 p.m., with the exception of the national holidays of the Republic of Serbia. Support services shall be obliged to respond to your complaint within 2 business days following the receipt of the complaint and shall be obliged to provide complete information.
9.Final Provision
9.1. In the event that one or more provisions of the T&C herein are no longer applicable for any reason, this shall not affect the other provisions of the T&C herein which shall remain in effect as though the provision never existed as its integral part.
9.2. For everything not regulated via the T&C herein, the relevant legal regulations in effect for the territory in which the PhiStock is located shall apply.
